1. Acceptance of Terms

By accessing or using UpOrGone ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

UpOrGone provides website and API uptime monitoring, alerting, and public status page hosting. We offer multiple subscription tiers with varying feature limits.

3. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use the Service.

4. Subscription & Billing

Paid plans are billed monthly or annually. All plans include a 7-day free trial. You may cancel at any time; cancellation takes effect at the end of the current billing period. Refunds are handled on a case-by-case basis.

5. Acceptable Use

You agree not to: use the Service for illegal purposes; attempt to overload or disrupt the Service; resell access without authorization; monitor endpoints you do not own or have permission to monitor.

6. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. We collect only the data necessary to provide the Service.

7. Uptime & Liability

While we strive for high availability, UpOrGone is provided "as is" without warranty. We are not liable for missed alerts, false positives, or downtime of our own Service. Our total liability is limited to the fees paid in the preceding 12 months.

8. Termination

We may suspend or terminate your account for violation of these terms. You may delete your account at any time from the Settings page. Upon deletion, your data will be permanently removed within 30 days.

9. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms. We will notify you of material changes via email.
